Terms and Conditions

The Royal Canadian Mint Masters Club Loyalty Program ("MC Program") is offered by the Royal Canadian Mint ("RCM", "we", "us" or "our"). These Terms and Conditions govern RCM customers' participation in the MC Program. By participating in the MC Program, customers agree to be bound by these Terms and Conditions.
MEMBERSHIP IN THE MC PROGRAM
Subject to the exclusions noted below, the MC Program is open to any individual who: (i) is a resident of Canada or the United States; and (ii) has registered for an account on mint.ca and opted into the MC Program ("Eligible Customer").
The following individuals are not eligible to participate in the MC Program: (i) RCM dealers and/or distributors; and (ii) individuals – including RCM employees and member of its board of Directors - that participate in any other discount or rebate program offered by the RCM.
A Member may only have one account in the MC Program. The creation of multiple accounts by the same individual is not permitted. The RCM reserves the right to take steps to verify whether a Member has complied with this requirement at any time. In the event that the RCM determines, in its sole and absolute discretion, that a Member has created multiple accounts, the RCM may cancel all accounts associated with that Member.
To become a member of the MC Program (a "Member") Eligible Customers must spend CA$250 (before tax) or more in Qualifying Purchases during a Program Year.
- A "Program Year" is the 365-day (or 366-day for a leap year) period from January 1 to December 31.
- A "Qualifying Purchase" is a purchase of an Eligible Product from the RCM directly through the RCM call centre, online at www.mint.ca, through the RCM mobile application or from one of the RCM's retail locations, for personal use (the purchase of Eligible Products from the RCM for resale or commercial use does not constitute a Qualifying Purchase). IMPORTANT: In order for the purchase of an Eligible Product from the RCM to count as a Qualifying Purchase, the Eligible Customer or Member must indicate their intention to have the Qualifying Purchase count towards their MC Program membership prior to completing the purchase. If an Eligible Customer or Member does not indicate their intention to have the purchase count towards their MC Program membership prior to completing the purchase, the purchase will not be considered a Qualifying Purchase and will not count towards their MC Program membership.

An "Eligible Product" is any RCM product with the exception of: (i) regular circulation coin rolls, such as any roll of five-cent coins, ten-cent coins, twenty-five cent coins, one-dollar coins and two-dollar coins; (ii) any commemorative circulation coin products sold as circulation coins (for example, any commemorative circulation coin product sold at face value); (iii) gift cards and sponsorship event cards, (iv) any products and services for which a personalized invoice was issued, (v) Bullion products, (vi) Premium Bullion products in special packaging, (vii) any RCM product advertised and/or sold with a suggested retail price greater than $500,000 CAD before any applicable taxes, and (viii) any excluded products and services identified by the RCM from time to time. The RCM reserves the right to add or exclude, at any time and in its sole discretion, products and services that are Eligible Products.
A Qualifying Purchase is counted towards membership once it has been invoiced to the customer. If a Member returns a Qualifying Purchase, or a part of, that purchase (either the entire purchase or a part of as the case may be) will be deducted from the Member's account.
Subject to the Return of RCM products section below, once a Member reaches a MC Program membership level during a Program Year, they will maintain that membership level for the remainder of that Program Year and for the following Program Year.

COLLECTING AND REDEEMING POINTS
A Member will receive points for each dollar spent on a Qualifying Purchase (before tax). Points are not earned on Qualifying Purchases made on mint.ca using guest checkout. No points are earned on a Qualifying Purchase made in whole or in part using points. For clarity, no points are earned on Bullion Products, Premium Bullion products in special packaging nor any RCM product advertised and/or sold with a suggested retail price greater than $500,000 CAD before any applicable taxes.

For the purposes of calculating points, if the amount of the Qualifying Purchase (before tax) is not a whole number, the amount will be rounded up to the nearest whole number. By way of example, if a Gold Member makes a Qualifying Purchase of $24.55 before tax, the amount will be rounded up to $25 for the purposes of calculating the points awarded.
If as a result of a Qualifying Purchase, a Member moves up a membership level that provides a higher number of points per dollar spent, the Member will not receive the higher number of points per dollar spent for any part of that Qualifying Purchase. The Member will only receive the higher number of points per dollar spent for their next Qualifying Purchase.
In no event will a Member receive cash, credit or any other type of refund for that part of a purchase made through the redemption of points. All returns and cancellations are subject to the RCM's Return & Cancellation Policy.
Members may redeem points towards Qualifying Purchases in increments of 1000 points. For every 1000 points redeemed, the Member will receive a discount of $1 off the price of the Qualifying Purchase. Points cannot be redeemed towards the payment of taxes or shipping. In addition, any Qualifying Purchase completed using the Paypal payment platform will not allow Members to redeem their points.
Members may pay for a portion of a Qualifying Purchase using points and the remainder using other traditional acceptable means of payment. Points will be applied first followed by the other means of payment.
Members may only use points once per transaction. For transactions completed on mint.ca or through the RCM mobile application, Members will be asked if they want to use their points at checkout. For transactions completed through the RCM call centre or at RCM's retail locations, Members will need to indicate their intent to use earned points before completing their transaction.
Once redeemed, the Member's points balance will be reduced accordingly. Redemption points cannot be used to pay taxes.
The RCM reserves the right, but has no obligation to, to verify a Member's identity prior to fulfilling a request to redeem points towards a Qualifying Purchase.
Return of Eligible Products purchased by using a mix of (i) earned points and (ii) traditional means of payment:
- In the event all Eligible Products purchased under a single Qualifying Purchase are returned in accordance with RCM's return policy, Members will be refunded the same amount of points and money used to complete the initial transaction.
- In the event some Eligible Products purchased under a single Qualifying Purchase are returned in accordance with RCM's return policy, Members will be reimbursed the amount of money used to complete the transaction first, and then reimbursed with points to equal the new net value of the Qualifying Purchase.
In no event will a Member receive cash, credit or any other type of refund for that part of a purchase made through the redemption of points. All returns are subject to the RCM's return policy.
GENERAL POINTS INFORMATION
No cash value, non-transferable. Points have no cash value and can only be redeemed towards Qualifying Purchases in accordance with these Terms and Conditions. Points cannot be transferred, sold, purchased or shared (including, in the event of a death, divorce, separation, or when a Member account is terminated or closed).
Points Expiry. All earned points on a Member's account will expire if a Member does not make a Qualifying Purchase in which points are earned or redeemed in a consecutive 24-month period.
Point Promotions. The RCM may (but has no obligation to) offer point promotions in the form and format to be determined by the RCM at its sole discretion. These promotions may be personalized based on a Member's purchases, preferences, activities, location, and other factors. Personalized promotions are valid only for the Member account to which they are offered. All promotional offers are subject to availability and the terms and conditions communicated under each promotion, which will govern in respect of the offer, in the event of any inconsistency with these Terms and Conditions. The RCM assumes no responsibility if a promotional offer is late, misdirected, or not received by Members.
RCM System Governs. The RCM assumes no responsibility for errors that may occur when recording the collection or redemption of points in Member accounts. The RCM's computer system is the official record of points in Member accounts. In the event that a Member believes that an error in points collection or redemption has occurred, the Member must contact the RCM call centre within thirty (30) days of the invoice date associated with a Qualifying Purchase in respect of which the points relate, and provide the sales receipt relating to the Qualifying Purchase. The RCM will determine in its sole and absolute discretion whether an error has occurred, and an adjustment is necessary. The number of points indicated on sales receipts and communications sent to Members may not reflect the current balance of points in the Member's account and the RCM takes no responsibility for any error in such materials. The RCM may debit a Member's account at any time and without prior notice if points have been mistakenly credited. The RCM is under no obligation to honour a request to use points that were mistakenly issued to a Member's account.
OTHER MC PROGRAM BENEFITS
Each membership level enjoys a variety of benefits made available by the RCM in its sole discretion. The RCM reserves the right to make changes to the available benefits for each membership level at any time without prior notice, except as required by law.
A Member who makes sufficient Qualifying Purchases in a Program Year to graduate from a lower membership level to a higher membership level becomes eligible for all new membership benefits associated with the higher membership level for the remainder of that Program Year and for the following Program Year, subject to any eligibility restrictions. Duplicate benefits will not be provided.

GENERAL
Membership is Non-Transferable. The Masters Club is an individual member recognition program. Member accounts are not transferable or assignable and cannot be combined, unless decided otherwise by the RCM.
Changes to the MC Program. The MC Program is a free loyalty program offered by the RCM to Eligible Customers and Members. The Effective Date and Last Updated Date for these Terms and Conditions is as set out above.
The RCM may, in its sole discretion, cancel, amend or modify the MC Program, or these Terms and Conditions, in whole or in part at any time in its sole and absolute discretion and without prior notice, except where prior notice is required by law. These changes may impact, for example (but not limited to): the nature of the benefits, points and other rewards provided under the MC Program, membership levels including the required spend on Qualified Purchases per Program Year in order to reach a membership level; rules relating to points issuance and redemption, including the amount of points issued per dollar spent and points redemption rules and amounts; the manner in which membership levels and eligibility for benefits, points and other rewards are determined; and what constitutes an Eligible Product and Qualifying Purchase.
Continued participation in the MC Program after any amendments or modifications to these Terms and Conditions constitutes a Member's acceptance of the amended or modified Terms and Conditions.
The RCM will have no liability whatsoever to any Member, Eligible Customer or other customer in respect of any cancellation, amendment or modification to the MC Program or these Terms and Conditions.
Special Rules for Members of the Prior Masters Club Program. Individuals who were members of the Masters Club Program during the 2020 program year ("Prior Program"), and who had a membership level of Silver or higher as of December 31, 2020, will be automatically enrolled into the MC Program effective January 1, 2021.
Non-Masters Club member under the 2020 Masters Club Program who made between $250 and $999.99 in Qualifying Purchases during the Program Year ending December 31, 2020, will need to opt-in to the new MC Program on mint.ca, RCM mobile application, through the RCM call center, or at an RCM retail location in order to start enjoying benefits under the MC Program. These customers will only enjoy benefits once they have opted in.
Member Passwords and Accounts. All RCM customers are responsible for keeping their account passwords secure. If a Member or other customer suspects that their account has been compromised, they should immediately change their password on mint.ca or contact the RCM call centre to have their password reset. Members and customers are responsible for all transactions on their account. The RCM is not responsible or liable for any points used or transactions made using compromised passwords.
Member's Obligation to Update Contact Information. Members are responsible for ensuring the accuracy of personal information provided to the RCM. Communications sent by the RCM to the email address or postal mail address associated with the Member's account are deemed to have been duly sent to the Member by the RCM.
Membership Termination by Member. A Member may opt out of the MC Program at any time by contacting the RCM call centre. Opting out of the MC Program does not automatically close the associated mint.ca account. Once a Member has opted out of the MC Program, that Member's MC Program account will be dormant for a period of twenty-four (24) months and no points may be earned or redeemed during this time. During this period, the Member may contact the RCM call center to rejoin the MC Program and if they do so, the points in the Member's account as of the date they opted out will be reinstated subject to the Points Expiry provision above. If no action is taken by the MC Member to rejoin the MC Program during the twenty-four (24) months dormancy period, the Member's MC Program account will be terminated and all points associated with the account – that may remain - will automatically and irrevocably expire and no further benefits or other rewards will be provided to the Member. Once a Member's MC Program account has been terminated it cannot be reinstated. Customers wishing to return to the MC Program will have to open a new MC Program account.
Membership Termination by the RCM. The RCM reserves the right in its sole and absolute discretion to terminate or cancel the membership of any Member who:
- Does not adhere to these Terms and Conditions;
- Engages in fraudulent, deceptive, dishonest or abusive behaviours in respect of the MC Program or the RCM generally;
- Does not make a Qualifying Purchase in which points are earned or redeemed within a consecutive twenty-four (24) month period; or'
- Dies.
The RCM may terminate or cancel membership without notice or other formality, except as may be required by law. When an account is terminated or cancelled, access to the account is revoked, all points associated with that account automatically and irrevocably expire, and the Member ceases to be eligible for any benefits or other rewards. Terminated or cancelled accounts cannot be reinstated.
RCM Discretion to Deny Membership. The RCM may deny membership to any individual who, in the RCM's sole and absolute discretion, does not meet the eligibility requirements of these Terms and Conditions or whose membership was previously revoked due to non-compliance with these Terms and Conditions or engaging in fraudulent, deceptive, dishonest or abusive behaviours.
Breach of these Terms and Conditions. No points are awarded if the RCM suspects that the products and/or services purchased will be used for resale or commercial use, and any points awarded for such purchases (which, for the avoidance of doubt, do not constitute Qualifying Purchases under these Terms and Conditions) will be cancelled. Members who have breached these Terms and Conditions undertake to reimburse the RCM for any losses or damages sustained by the RCM or any third party, as the case may be, because of such breach.
Discretionary benefits. The RCM reserves the right, in its sole discretion, to provide Members, Eligible Customers and other RCM customers additional rewards or benefits, including based on the Member's or customer's relationship with the RCM, purchase history and geographic location.
Return of RCM products. All returns are subject to the RCM's return policy. If a Member returns a product to the RCM, any free gift(s) received as a result of the original purchase must be returned along with the product. A Member may also lose his or her MC Program membership or be moved down to a lower membership level, if his or her Qualifying Purchases from the RCM during a Program Year drops below the applicable minimum purchase amount as a result of the return. See above for impact of returns on points issuance and redemption.
Recording of Qualifying Purchases. A Qualifying Purchase is counted towards membership once it has been invoiced to the customer. If a Qualifying Purchase is made in one Program Year, and invoiced to customer in the following Program Year, that Qualifying Purchase will only be counted towards membership in the Program Year in which the Qualifying Purchase was invoiced. The RCM is not responsible for any delays in invoicing Qualifying Purchases.
No Warranties or Representations. The RCM makes no warranties, conditions or representations, either expressed or implied, including with respect to merchantability or fitness for a particular purpose, with respect to the MC Program, membership in the MC Program, or any benefits or rewards related to the MC Program.
Not Responsible for Acts, Errors, or Omissions. The RCM is not responsible for: (a) any errors or omissions in these Terms and Conditions; or (b) any errors or omissions in any materials published in relation to the MC Program. The RCM is also not responsible if the MC Program cannot be carried out as planned, including if it becomes impossible or impractical to provide certain benefits under the MC Program, due to circumstances beyond the RCM's reasonable control.
Official Marks. Masters Club wordmark, MC, and their logos are the official marks of the RCM.
Trademarks. Masters Club wordmark, MC, and their logos are the trademarks of the RCM, and Eligible Customers and Members shall never, directly or indirectly, interfere with, challenge, or file applications for these trademarks anywhere in the world.
Waiver. The RCM's waiver of any breach of these Terms and Conditions by any Eligible Customer or Member will not constitute a waiver of any other prior or subsequent breach of these Terms and Conditions. The RCM's failure to insist upon strict compliance with these Terms and Conditions by any Eligible Customer or Member will not be deemed a waiver of any rights or remedies that the RCM may have against that, or any other, Eligible Customer or Member.
Limitation of Liability. The RCM and its employees, officers and directors (the "Released Parties") are not liable or responsible for, and each Eligible Customer and Member releases and holds harmless each of the Released Parties from, any claims in respect of any loss, damage, cost, injury, expense or inconvenience ("Damages") however suffered or caused arising as a result of or in connection with the MC Program, the suspension or termination of the MC Program, these Terms and Conditions and any amendment thereof, and use of any products, goods or services of the RCM regardless of whether the Released Parties were or could have been aware of the possibility of such Damages. This is a comprehensive limitation of liability that applies to all damages of any kind, including but not limited to direct, indirect, special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with the MC Program or these Terms and Conditions.
Complete Agreement. These Terms and Conditions represent the only agreement between the RCM and Eligible Customers and Members in connection with the MC Program and supersede all prior agreements and understandings. All decisions relating to the MC Program and the interpretation of these Terms and Conditions are at the RCM's sole discretion and will be final and binding.
References. All dollar amounts referred to in these Terms and Conditions are in Canadian dollars. This is applicable to all collateral materials related to the MC Program. All times referred to in these Terms and Conditions are Eastern Time.
Dispute Resolution and Choice of Law. These Terms and Conditions shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein, and all Eligible Customers and Members agree to attorn to the jurisdiction of the Province of Ontario. Any proceedings relating to the MC Program shall be brought exclusively in the courts of Ontario and any orders of such courts shall be binding on Eligible Customers and Members
