Legal notice, disclaimer and terms of use
Your access to and use of the Royal Canadian Mint (the "Mint") website (the "Website"), and your access to, use of and engagement with the Mint's social media pages and accounts (the Mint's "Social Media") are subject to the following terms and conditions
PLEASE READ THESE TERMS CAREFULLY AS ACCESS TO AND USE OF THE WEBSITE AND/OR ACCESS TO, USE OF OR ENGAGEMENT WITH THE MINT'S SOCIAL MEDIA, AS APPLICABLE, CONSTITUTES ACCEPTANCE OF THE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE WEBSITE OR ACCESS, USE OR ENGAGE WITH THE MINT'S SOCIAL MEDIA.
Please note that your access to, use of and engagement with the Mint's Social Media is also subject to the terms of service/use of the relevant third party social media platform providers. The Mint has no control over the social media platform providers' terms of service/use, but you are strongly encouraged to read them as well.
Amendments
The Mint reserves the right to modify these Terms at any time without prior notice, and such modifications shall be effective immediately after such changes are posted. You agree that your continued access or use of the Website and/or access, use of or engagement with the Mint's Social Media after any changes are posted shall be deemed to constitute your acceptance of the Terms as modified. It is your responsibility to review these terms regularly. These Terms were last updated on December 2, 2021.
The Website may permit you to place orders to purchase products from the Mint. The Mint reserves the right to refuse or limit orders, and to change its prices and product offerings without notice if, for any reason, it should be found necessary to do so. The Mint also reserves the right to impose purchase quantity limits on certain items. While every effort is made to ensure the accuracy of the information, images and prices provided, the Mint reserves the right to make corrections if an error does occur.
International shipping to a U.S.A. address for orders that equal or exceed CAD $2,500 in value:
The United States Customs and Border Protection (USCBP) requires that the U.S.-Based Ultimate Consignee or Foreign-Based Ultimate Consignee, or receiver of the goods, provides a U.S. Social Security Number (SSN) or Internal Revenue Service (IRS) employer identification number for any order equal to or exceeding CAD $2,500. In order to comply with the U.S.A. Customs regulations, the Mint will now require your SSN or IRS number when you place an order that equals or exceeds CAD $2,500 in value. This information will be recorded in the U.S.A. Customs Service computer system for customs purposes only.
Copyright
Unless otherwise noted, the information, text, photographs, software, animation files, graphics, video and audio files, and other materials contained on the Website and/or posted or shared by the Mint on its Social Media (collectively the "Contents") are owned by the Mint, or the Mint otherwise has the right to use said Contents, and said Contents are protected by domestic and international copyright laws and other intellectual property laws.
Except as specifically permitted herein, no portion of the Contents may be reproduced in any form or by any means without the prior written consent of the Mint.
Trademarks
The trademarks and logos displayed on this Website and/or on the Mint's Social Media are the property of the Mint or other third parties. You are not permitted to use the trademarks displayed without the prior written consent of the Mint or any such third parties that may own the trademarks.
Use of Website and Social Media Contents
Reproduction, transfer, distribution, storage of part or all of the Contents in any form without the prior written consent of the Mint is prohibited, unless otherwise specified. However, you are permitted to download one (1) copy of the Contents on your computer or other device for your personal, non-commercial use provided you keep intact all copyright, trademark, and other proprietary notices. You may not modify, reformulate, adapt, alter, adjust, change, disassemble, frame or decrypt any of the Contents.
The use of news releases and other documents classified as public is permitted in public communications if the source of the information is stated.
The Mint reserves the right to require that you delete, destroy or otherwise cease using any Contents that are used in a manner that in the Mint's opinion is contrary to these Terms or applicable laws, or is otherwise inappropriate, derogatory or offensive.
Links to Third-Party Websites; Following, 'Favouriting', Subscribing and Sharing
For your convenience, the Mint may display, post or share links to websites or social media accounts that are owned or operated by third parties. By accessing such a third-party site or account, you understand that it is independent from the Mint, and that the Mint has no control over the content of such third-party site or account and does not assume any responsibility for any information or materials created, published or transmitted by such third-party site or account. In addition, a link to a third-party's site does not imply that the Mint endorses the site or account or the information or the content found through the link. It is your responsibility to ensure that you review and agree to the terms and conditions applicable to the website or content of a third party before using or accessing it.
Furthermore, the Mint's decision to follow, "like" or subscribe to a third party's social media account does not imply an endorsement of that account, channel, page or site, and neither does sharing (e.g. re-tweeting, reposting or linking to) content from another social media account.
Privacy
The Mint's Privacy Notice is a binding part of these Terms. Please ensure to read the Privacy Notice carefully.
User Submissions and Posting Policy
The Mint welcomes your comments. However, unless otherwise explicitly stated, you agree that any information, comments, materials or content that you send, share, post or submit to the Mint's servers, the Website or the Mint's Social Media ("Submission(s)") will not be treated as confidential. With respect to each of your Submissions, you represent, warrant and agree:
- that you are entirely responsible for your Submission;
- that your Submission does not contain any item that is unlawful or otherwise unfit or a violation of these Terms, including the Posting Policy;
- that your Submission is accurate and does not include any false or misleading information, and, if your Submission contains a testimonial, that this reflects your true and honest belief based on your experience with the relevant product or service;
- that you own the intellectual property in your Submission or have the right to use it, and that its use by the Mint will not interfere with or infringe the intellectual property rights, privacy rights, proprietary rights or other rights of any third parties;
- to grant the Mint an unrestricted, perpetual, worldwide, royalty-free, irrevocable and sub-licensable license to use, reproduce, display, perform, modify, transmit, create derivative works from and distribute the Submission, in any format or media, for any purpose without liability and without any further compensation;
- to waive all moral rights in and to the Submission in favour of the Mint and anyone authorized by the Mint to reproduce or otherwise use the Submission; and
- that you have all of the rights, power and authority necessary to grant the above license and waiver of moral rights.
YOU AGREE NOT TO TAKE ACTION AGAINST THE MINT IN RELATION TO YOUR SUBMISSION(S) AND YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE MINT IF ANY THIRD PARTY TAKES ACTION IN RELATION TO SUCH SUBMISSION(S), INCLUDING BUT NOT LIMITED TO ANY CLAIMS OR ACTIONS BASED ON VIOLATION OF PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, OR COPYRIGHT, TRADEMARK OR OTHER INTELLECTUAL PROPERTY INFRINGEMENT.
The Mint may review Submissions posted or shared on the Website or on the Mint's Social Media and may participate in discussions where appropriate.
The Mint will not engage in partisan issues or respond to questions that violate these Terms.
Please note that any user Submissions appearing on the Website or the Mint's Social Media do not necessarily reflect the views of the Mint and are not endorsed or approved by the Mint. The Mint is not responsible for and disclaims all liability for user Submissions.
Your Submissions must be relevant and respectful. While the Mint has no obligation to screen or review any Submissions, the Mint reserves the right, at its sole discretion, to remove (or to require the removal of) a Submission, to block users, and/or to take any other steps deemed appropriate, in the event that the user's Submission(s):
- includes personal information;
- is written in a language other than English or French;
- infringes upon or interferes with intellectual property, privacy or proprietary rights;
- is contrary to the principles of the Canadian Charter of Rights and Freedoms, Constitution Act, 1982;
- is defamatory or contains a personal attack;
- is racist, hateful, sexist, homophobic or discriminatory;
- is threatening, violent, abusive, intimidating or harassing;
- contains or refers to any obscenity or pornography;
- is otherwise inappropriate, objectionable or offensive, or could be considered as such;
- is contrary to Canadian laws or any applicable foreign laws;
- constitutes impersonation, advertising or spam;
- encourages or incites any criminal activity;
- is repetitive, irrelevant, off-topic or unintelligible;
- is politically partisan; and
- otherwise violates these Terms or any applicable third party terms (e.g. the terms of the relevant social media platform).
Disclaimers and Limitations of Liability
THE WEBSITE AND THE CONTENTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE MINT DOES NOT WARRANT THAT THE USE OF THE WEBSITE OR THE MINT'S SOCIAL MEDIA WILL BE UNINTERRUPTED, ERROR-FREE, STABLE OR SUITABLE. THE MINT MAKES NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, ABOUT THE MINT'S SOCIAL MEDIA OR THE WEBSITE, THEIR AVAILABILITY, THEIR OPERATION, OR ANY OF THE CONTENTS, INCLUDING, WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, OR COURSE OF DEALING.
Please note that as social media platforms are managed by third parties, they are subject to downtime that is out of the Mint's control; the Mint accepts no responsibility for such platforms (and, as a result, the Mint's Social Media) becoming unresponsive or unavailable.
Information available on this website or posted or shared by the Mint's Social Media could include technical or other inaccuracies or typographical errors. The Mint may make improvements and/or changes to the Contents of this website or to the Contents posted or shared by the Mint's Social Media at any time and without notice.
IN NO EVENT, IN REGARD TO THIS WEBSITE, ANY OF THE MINT'S SOCIAL MEDIA, OR ANY OTHER THIRD PARTY-LINKED WEBSITE OR SOCIAL MEDIA ACCOUNT, WILL THE MINT BE LIABLE TO ANY PARTY FOR ANY SPECIAL, INCIDENTAL, DIRECT, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND OR DAMAGES WHATSOEVER INCLUDING WITHOUT LIMITATION, THOSE RESULTING FROM ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, LOSS OF PROFITS, BUSINESS INTERRUPTION AND LOSS OF DATA, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE, AND HOWEVER CAUSED.
Indemnity
You agree to defend, indemnify and hold harmless the Mint from and against any and all losses, damages, liabilities, claims, actions, suits, costs and expenses, including reasonable attorney's fees, arising from or relating to any violation of these Terms by you, or your access to, use of, or engagement with of the Website or the Mint's Social Media, including but not limited to any of your Submissions.
Jurisdiction
The Mint controls the Website (excluding linked sites) from its offices within the Province of Ontario, Canada. You and the Mint agree that these Terms, the subject matter of these Terms, and all related matters shall be governed by, and construed in accordance with, the laws of the Province of Ontario. You and the Mint also agree and hereby submit to the exclusive personal jurisdiction and venue of the courts of the Province of Ontario with respect to such matters.
The Mint makes no representation that the Website, the Mint's Social Media and the Contents are appropriate or available for use in other locations, and accessing the Website or the Mint's Social Media from territories where their contents are illegal or prohibited. Those who choose to access or use the Website or to access, use or engage with the Mint's Social Media from other locations do so at their own initiative and risk and are responsible for compliance with local laws.
Invalidity
If, for any reason whatsoever, any terms and conditions of the Terms are deemed by a court to be void, voidable or otherwise unenforceable, such determination shall not affect the remaining provisions hereof.
Changes
The Mint reserves the right to change or remove any Contents, features or functions of the Website or its Social Media, in whole or in part, at its sole discretion, at any time without notice. The Mint may also discontinue its use of any of its Social Media at any time without notice, including but not limited to closing down any of its Social Media.
Waiver
The Mint's failure to insist upon or to enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right.
